A bolestiv\u00e1. Bolestiv\u00e9 je samoz\u0159ejm\u011b i \u0159e\u0161en\u00ed administrativn\u00edch z\u00e1le\u017eitost\u00ed spojen\u00fdch s rozvodem. Pakli\u017ee jste se opravdu rozhodli man\u017eelsk\u00e9 sou\u017eit\u00ed ukon\u010dit, je rozvod nezbytn\u00fdm krokem, kter\u00fd je nutno u\u010dinit.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Jak se rozv\u00e9st \u201ev klidu\u201c (nesporn\u011b)?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Z\u00e1le\u017e\u00ed na tom, nakolik jste schopni s parnerem \u010di partnerkou komnunikovat.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ide\u00e1ln\u00ed variantou je samoz\u0159ejm\u011b nesporn\u00fd rozvod, na kter\u00e9m se dohodnete. Soudn\u00ed st\u00e1n\u00ed je v takov\u00e9m p\u0159\u00edpad\u011b pouze formalitou, le\u010d aby tomu tak bylo, je nutno soudu dolo\u017eit ur\u010dit\u00e9 lisitny.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Jak\u00e9 podm\u00ednky mus\u00edte splnit, aby do\u0161lo k nesporn\u00e9mu rozvodu?&nbsp;<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pokud druh\u00fd man\u017eel s rozvodem souhlas\u00ed, sepi\u0161te n\u00e1vrh (\u017ealobu) na rozvod man\u017eelstv\u00ed. Aby mohl soud p\u0159istoupit k tzv. \u201enesporn\u00e9mu rozvodu\u201c, tzn. abyste se v soudn\u00ed s\u00edni zdr\u017eeli co nejkrat\u0161\u00ed dobu\u2026<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>mus\u00ed man\u017eelstv\u00ed trvat nejm\u00e9n\u011b rok a 6 m\u011bs\u00edc\u016f spolu ji\u017e ne\u017eijete,<\/li>\n\n\n\n<li>m\u00e1te-li nezletil\u00e9 d\u011bti, dohodn\u011bte se na \u00faprav\u011b pom\u011bru k nezletil\u00fdm d\u011btem a podejte n\u00e1vrh na schv\u00e1len\u00ed dohody rodi\u010du ve vztahu k d\u011btem,&nbsp;<\/li>\n\n\n\n<li>uzav\u0159ete dohodu o \u00faprav\u011b majetkov\u00fdch pom\u011br\u016f a vy\u0159e\u0161te sv\u00e9 bydlen\u00ed na dobu po rozvodu.&nbsp;<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Budete tedy pot\u0159ebovat celkem 3 listiny.&nbsp;<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>N\u00e1vrh na schv\u00e1len\u00ed dohody rodi\u010d\u016f o \u00faprav\u011b pom\u011bru k nezletil\u00fdm d\u011btem\n<ul class=\"wp-block-list\">\n<li>Pr\u00e1v\u011b tato podm\u00ednka v praxi p\u0159in\u00e1\u0161\u00ed nejv\u00edce probl\u00e9m\u016f a bohu\u017eel se mnohdy \u00faka\u017ee jako nesplniteln\u00e1.<\/li>\n\n\n\n<li>Rozumn\u00fd rodi\u010d si p\u0159eje, aby byly d\u011bti rozvodem co nejm\u00e9n\u011b zasa\u017eeny. Je proto i v jeho z\u00e1jmu dohodnout se s druh\u00fdm rodi\u010dem na tom, jak to bude s d\u011btmi po rozvodu.&nbsp;<\/li>\n\n\n\n<li>Je t\u0159eba si uv\u011bdomit, \u017ee druh\u00fd rodi\u010d m\u00e1 stejn\u00e9 pr\u00e1vo na styk s d\u011btmi jako Vy. D\u011bti z\u00e1rove\u0148 pot\u0159ebuj\u00ed druh\u00e9ho rodi\u010de. A\u010dkoli se m\u016f\u017eete c\u00edtit uk\u0159ivd\u011bni, nen\u00ed to d\u016fvod, abyste otci\/matce, ale p\u0159edcev\u0161\u00edm d\u011btem, up\u00edrali pr\u00e1vo v\u00eddat se s t\u00edm druh\u00fdm. Pokuste se vn\u00edmat v\u011bc o\u010dima toho druh\u00e9ho a tak\u00e9 d\u011bt\u00ed.&nbsp;<\/li>\n\n\n\n<li>Oslovte org\u00e1n soci\u00e1ln\u011b pr\u00e1vn\u00ed ochrany d\u011bt\u00ed (na m\u00edstn\u00edm obecn\u00edm \u00fa\u0159ad\u011b). M\u016f\u017ee V\u00e1m pomoci se dohodnout.&nbsp;<\/li>\n\n\n\n<li>Dosp\u011bjete-li k dohod\u011b, sepi\u0161te ji a podejte n\u00e1vrh k soudu na jej\u00ed schv\u00e1len\u00ed.&nbsp;<\/li>\n\n\n\n<li>Pokud dohoda neodporuje z\u00e1jmu nezletil\u00fdch d\u011bt\u00ed, soud dohodu schv\u00e1l\u00ed.&nbsp;<\/li>\n\n\n\n<li>Po pr\u00e1vn\u00ed moci rozsudku o schv\u00e1len\u00ed dohody se otev\u00edr\u00e1 cesta k rozvodu.&nbsp;<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>Dohoda o uspo\u0159\u00e1d\u00e1n\u00ed majetkov\u00fdch pom\u011br\u016f a bydlen\u00ed na dobu po rozvodu\n<ul class=\"wp-block-list\">\n<li>I zde v praxi nast\u00e1vaj\u00ed komplikace a po pr\u00e1vn\u00ed str\u00e1nce se jedn\u00e1 o velmi komplikovan\u00e9 spory.&nbsp;<\/li>\n\n\n\n<li>Podstatou dohody je vypo\u0159\u00e1dat majetek, kter\u00fd spad\u00e1 do spole\u010dn\u00e9ho jm\u011bn\u00ed man\u017eel\u016f.&nbsp;<\/li>\n\n\n\n<li>Dohoda m\u00e1 v\u017edy p\u0159ednost p\u0159ed z\u00e1konem. Jak si uspo\u0159\u00e1d\u00e1te majetkov\u00e9 pom\u011bry je \u010dist\u011b na V\u00e1s.&nbsp;<\/li>\n\n\n\n<li>Zohledn\u011bte, nakolik se druh\u00fd z man\u017eel\u016f zaslou\u017eil o spole\u010dn\u00e9 jm\u011bn\u00ed, ALE\u2026<\/li>\n\n\n\n<li>Nezapome\u0148te na to, \u017ee i p\u00e9\u010de o d\u00edt\u011b a dom\u00e1cnost je d\u016fle\u017eit\u00e1 a srovnateln\u00e1 s \u201evyd\u011bl\u00e1v\u00e1n\u00edm pen\u011bz\u201c.&nbsp;<\/li>\n\n\n\n<li>V dohod\u011b ur\u010dete, kter\u00fd majetek p\u0159ipadne tomu kter\u00e9mu z man\u017eel\u016f. Nezapome\u0148te na \u00faspory a pen\u00edze na \u00fa\u010dtech. By\u0165 jsou \u00fa\u010dty vedeny na jm\u00e9no jednoho z V\u00e1s, prost\u0159edky na nich spadaj\u00ed do SJM. Stejn\u011b tak je tomu se spo\u0159en\u00edm.&nbsp;<\/li>\n\n\n\n<li>Pokud m\u00e1te v SJM nemovitosti, je t\u0159eba je specikovat tak, aby v\u0161e pro\u0161lo p\u0159es katastr\u00e1ln\u00ed \u00fa\u0159ad. I drobn\u00e1, form\u00e1ln\u00ed vada, m\u016f\u017ee v\u00e9st k zam\u00edtnut\u00ed n\u00e1vrhu.&nbsp;<\/li>\n\n\n\n<li>Vlastn\u00edte-li nemovitosti, je t\u0159eba podat katastr\u00e1ln\u00edmu \u00fa\u0159adu n\u00e1vrh na vklad zm\u011bn, a to do 3 let od pr\u00e1vn\u00ed moci rozsudku o rozvodu man\u017eelstv\u00ed. Dokud K\u00da vklad neprovede, nen\u00ed zm\u011bna \u00fa\u010dinn\u00e1 a po uplynut\u00ed t\u00e9to lh\u016fty se st\u00e1v\u00e1te pod\u00edlov\u00fdmi spoluvlastn\u00edky.&nbsp;<\/li>\n\n\n\n<li>Vypo\u0159\u00e1dejte i dluhy. V p\u0159\u00edpad\u011b zaji\u0161t\u00e9n\u00ed z\u00e1stavn\u00edm pr\u00e1vem, kontaktujte banku.<\/li>\n\n\n\n<li>Dohodn\u011bte se, kde kdo bude bydlet.&nbsp;<\/li>\n\n\n\n<li>Nezapome\u0148te na dohod\u011b ov\u011b\u0159it podpisy.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>N\u00e1vrh na rozvod man\u017eelstv\u00ed\n<ul class=\"wp-block-list\">\n<li>Pokud jste se dohodli na \u00fapravu styku s d\u011btmi a \u00faprav\u011b majtekov\u00fdch pom\u011br\u016f, jedn\u00e1 se o nejjednodu\u0161\u00ed \u010d\u00e1st.&nbsp;<\/li>\n\n\n\n<li>V \u017ealob\u011b stru\u010dn\u011b vyl\u00ed\u010d\u00edte d\u016fvody rozpadu Va\u0161eho vztahu (vz\u00e1jemn\u00e9 odcizen\u00ed apod.).&nbsp;<\/li>\n\n\n\n<li>Uvedete, \u017ee man\u017eelstv\u00ed trvalo minim\u00e1ln\u00e9 rok a \u0161est m\u011bs\u00edc\u016f spolu ne\u017eijete.&nbsp;<\/li>\n\n\n\n<li>Oba se k n\u00e1vrhu p\u0159ipoj\u00edte (podep\u00ed\u0161ete).<\/li>\n\n\n\n<li>Sd\u011bl\u00edte soudu, \u017ee jste podali n\u00e1vrh na schv\u00e1len\u00ed dohody o \u00faprav\u011b pom\u011br\u016f k d\u011btem a p\u0159ipoj\u00edte dohodu o majetku s ov\u011b\u0159en\u00fdmi podpisy.<\/li>\n\n\n\n<li>Samotn\u00e9 jedn\u00e1n\u00ed o rozvodu by m\u011bla b\u00fdt formalita. Soudce se V\u00e1s dot\u00e1\u017ee, zda na n\u00e1vrhu trv\u00e1te a pova\u017eujete uveden\u00e9 skute\u010dnosti za nesporn\u00e9. Pokud potvrd\u00edte, \u017ee ano, nem\u011blo by to trvat d\u00e9le, ne\u017e 10 minut.&nbsp;<\/li>\n\n\n\n<li>Soud vyhl\u00e1s\u00ed rozsudek. M\u016f\u017eete se vzd\u00e1t pr\u00e1va na odvol\u00e1n\u00ed.&nbsp;<\/li>\n\n\n\n<li>Doru\u010den\u00edm nabude rozsudek pr\u00e1vn\u00ed moci, a jste rovedeni.&nbsp;<\/li>\n\n\n\n<li>Po pr\u00e1vn\u00ed moci rozsudku o rozvodu man\u017eelstv\u00ed je v\u0161emu konec.&nbsp;<\/li>\n\n\n\n<li>Pokud jste v\u0161ak vlastnili a vypo\u0159\u00e1d\u00e1vali nemovitosti, mus\u00edte podat n\u00e1vrh na vklad zm\u011bn k nemovitostem p\u0159\u00edslu\u0161n\u00e9mnu katastr\u00e1ln\u00edmu \u00fa\u0159adu.&nbsp;<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">By\u0165 ustanoven\u00ed ob\u010dasnk\u00e9ho z\u00e1kon\u00edku (\u00a7 757) p\u016fsob\u00ed pom\u011brn\u011b jednodu\u0161e, jak u\u017e to b\u00fdv\u00e1, je t\u0159eba dost\u00e1t v\u00fd\u0161e uveden\u00fdm form\u00e1ln\u00edm po\u017eadavk\u016fm.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Jak to prob\u00edha?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nev\u00edte-li si rady, nebo nechcete-li se p\u0159\u00edpravou listin zat\u011b\u017eovat, konaktujte n\u00e1s.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sejdeme se. Na \u00favodn\u00ed sch\u016fzku si p\u0159inesete oddac\u00ed list, rodn\u00e9 listy d\u011bt\u00ed a \u00fadaje o majetku.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nem\u00e1te-li p\u0159\u00edli\u0161 \u010dasu, po\u0161lete n\u00e1m podklady mailem.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">P\u0159\u00edprav\u00edme nezbytn\u00e9 listiny, kter\u00e9 V\u00e1m za\u0161leme k p\u0159\u00edpadn\u00fdm p\u0159ipom\u00ednk\u00e1m. Jakmile bude v\u0161e hotovo, pod\u00e1me je p\u0159\u00edslu\u0161n\u00e9mu soudu.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">M\u00e1te-li nezletil\u00e9 d\u011bti, rozhodne soud nejprve o schv\u00e1len\u00ed dohody o \u00faprav\u011b pom\u011br\u016f. Po pr\u00e1vn\u00ed moci rozhodnut\u00ed bude na\u0159\u00edzeno jedn\u00e1n\u00ed o rozvod man\u017eelstv\u00ed. To b\u00fdv\u00e1 zpravidla (v p\u0159\u00edpad\u011b nesporn\u00e9ho rozvodu) formalitou.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Po rozvodu man\u017eelstv\u00ed pod\u00e1me p\u0159\u00edslu\u0161n\u00fd n\u00e1vrh na vklad zm\u011bn vlastnick\u00e9ho pr\u00e1va do Katastru nemovitost\u00ed. (V p\u0159\u00edpad\u011b zaji\u0161t\u011bn\u00ed \u00fav\u011bru z\u00e1stavn\u00edm pr\u00e1vem pro V\u00e1s p\u0159iprav\u00edme \u017e\u00e1dosti pro banku).&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Kolik to stoj\u00ed?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A\u0165 u\u017e se rozhodnete p\u0159ipravit v\u0161e sv\u00e9pomoc\u00ed nebo vyu\u017e\u00edt advok\u00e1ta, v\u017edy zaplat\u00edte soudn\u00ed poplatek ve v\u00fd\u0161i&nbsp;<strong>2.000,-K\u010d<\/strong>&nbsp;za n\u00e1vrh na rozvod. N\u00e1vrh na schv\u00e1len\u00ed dohody o d\u011btech je od soudn\u00edho poplatku osvobozen.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Vlastn\u00edte-li nemovitosti, je t\u0159eba po\u010d\u00edtat rovn\u011b\u017e se spr\u00e1vn\u00edm poplatkem katastr\u00e1ln\u00edmu \u00fa\u0159adu ve v\u00fd\u0161i&nbsp;<strong>1.000,-K\u010d<\/strong>.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">V p\u0159\u00edpad\u011b, \u017ee nevlastn\u00edte nemovitosti, zpracujeme V\u00e1m v\u0161e pot\u0159ebn\u00e9 za&nbsp;<strong>11.000,-K\u010d<\/strong>. (V cen\u011b nejsou zahrnuty soudn\u00ed a spr\u00e1vn\u00ed poplatky).&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pokud nemovitosti vlastn\u00edte a nen\u00ed jich v\u00edce ne\u017e 5, zpracujeme ve\u0161ker\u00e9 listiny za&nbsp;<strong>14.000,-K\u010d.<\/strong>&nbsp;(V cen\u011b nejsou zarnuty soudn\u00ed a spr\u00e1vn\u00ed poplatky).&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">U v\u00edce ne\u017e 5 nemovitost\u00ed m\u00e1te 5 nemovitost\u00ed v \u010dastce&nbsp;<strong>14.000,-K\u010d<\/strong>. Za ka\u017ed\u00fdch dal\u0161\u00edch 5 nemovitost\u00ed si \u00fa\u010dtujeme \u010d\u00e1stku&nbsp;<strong>700,-K\u010d<\/strong>.
